Payment Plan Agreement
This agreement supplements the Terms of Sale and governs any domain purchased on a payment plan.
1. Structure
Available terms and pricing markup over the listed cash price:
| Term | Markup | Deposit |
|---|---|---|
| 6 months | +5% | 15% |
| 12 months | +10% | 15% |
| 24 months | +20% | 20% |
| 36 months | +30% | 25% |
The total purchase price equals the cash price plus the markup for the chosen term. The deposit is calculated from the total purchase price and is paid up front.
2. Domain Ownership During the Plan
The domain registration remains in the Seller's registrar account for the full duration of the plan. The Seller will configure DNS so that the Buyer can point the domain at their own website, email, or services. The Buyer is granted a non-exclusive, non-transferable licence to use the domain in this way for as long as payments are current.
Title to the domain transfers to the Buyer only when the final instalment has cleared. At that point the Seller will push the domain to the Buyer's registrar within 7 business days.
3. Payments
- The deposit is paid by bank transfer before any DNS access is granted. Deposits are non-refundable.
- Monthly instalments are due on the same day of each calendar month, starting one month after the deposit clears.
- All payments are made by bank transfer in GBP. No card payments; no Stripe; no PayPal.
- The Buyer is responsible for any wire fees or intermediary bank charges.
4. Late Payment & Default
- If a monthly instalment is more than 7 days overdue, the Seller will send a written reminder by email.
- If a payment is more than 14 days overdue, the Seller may suspend DNS for the domain without further notice. The Buyer's website and email tied to the domain will stop working during suspension.
- If a payment is more than 30 days overdue, the Seller may terminate this agreement, retain all payments made to date as liquidated damages, and re-list the domain. The Buyer forfeits any further claim to the domain.
5. Early Settlement
The Buyer may settle the remaining balance at any time without penalty. On full settlement the domain is pushed to the Buyer's registrar within 7 business days.
6. Restrictions While the Plan is Active
While the plan is active and the Seller still owns the domain, the Buyer agrees not to:
- Use the domain for unlawful, defamatory, infringing, or fraudulent purposes.
- Use the domain in a way that brings the Seller's registrar account into disrepute or risks suspension.
- Apply for a trademark in the name of the domain (or a confusingly similar mark) before completing the plan.
- Attempt to initiate a registrar-to-registrar transfer or auth-code request.
Breach of these restrictions is a material default under section 4.
7. No Buyer Rights Until Completion
Until the final payment has cleared, the Buyer has no ownership interest in the domain. The DNS licence does not constitute a transfer of any intellectual property or registration right.
8. Chargebacks
Bank transfers are the only accepted method specifically to eliminate chargeback risk. Any attempt to reverse a bank transfer through fraudulent means will be treated as a material default and pursued through the courts.
9. Acceptance
This Agreement becomes binding once the Buyer confirms acceptance by email and the deposit has cleared. Both parties retain a copy of the accepted terms by email.
10. Governing Law
This Agreement is governed by the laws of England and Wales, with exclusive jurisdiction of the courts of England and Wales.
